Despite the lingering aftershocks of a U.S. Supreme Court ruling that struck down much of his previous tariff policy, the President has moved to raise the newly imposed "global tariff" from 10% to 15%, while threatening additional levies and new licensing fees.

This maneuver marks a volatile new chapter in the ongoing tariff saga, rattling financial markets, disrupting sensitive trade negotiations, and igniting a legislative firestorm on Capitol Hill regarding a potential refund bill exceeding $175 billion.

Legal Pivot: From IEEPA to Section 122

Less than 24 hours after signing an executive order for a 10% blanket tariff in response to the Supreme Court's decision, Trump hiked the rate to 15% - the statutory maximum allowed under Section 122 of the Trade Act of 1974.

The Supreme Court had previously invalidated the bulk of Trump’s tariff program, which relied on the International Emergency Economic Powers Act (IEEPA), ruling that the President had exceeded his executive mandate. In a strategic pivot, the administration turned to Section 122, which permits broad, temporary tariffs for a maximum duration of five months (150 days).

However, economists note that while the nominal rate rose by five percentage points, the "effective rate" may only increase by roughly two points - from approximately 12.5% to 14.5% - due to the retention of various exemptions from previous tariff rounds.

Diplomatic Fallout and the Reversal for Allies

In response to this political and legal uncertainty, the European Parliament on Monday officially suspended the ratification of a pending U.S.-EU trade agreement.

Democratic Pressure Over $175 Billion in Refunds

On Capitol Hill, Senate Democrats were quick to capitalize on the court’s ruling. A group of senators, led by Sens. Ron Wyden, Jeanne Shaheen, and Ed Markey, introduced a bill on Monday demanding the government refund duties collected under the now-defunct IEEPA-based policies.

The bill mandates that U.S. Customs and Border Protection (CBP) must:

●    Process refunds (including interest) within 180 days.

●    Prioritize payments to small businesses.

According to estimates from the Penn Wharton Budget Model, the federal government could be liable for a staggering restitution amount exceeding $175 billion.

The Administration’s Next Strategic Moves

Beyond the Section 122 hike, Trump indicated the administration would pursue additional Section 301 investigations under the Trade Act of 1974 to target alleged unfair trade practices. Section 301 duties require specific investigative findings and typically take several months to implement formally.

In social media posts, the President argued that the court's ruling does not eliminate other tariff authorities and floated the idea of using "license fees" as a new mechanism to exert pressure on global trading partners.
